These Terms & Conditions (“Terms”) govern your access to and use of the ModeMate website located at https://modemateai.com, the ModeMate mobile application, and related services (collectively, the “Service”).

The Service is operated by ModeMate Technologies, LLC, doing business as ModeMate (“ModeMate,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use ModeMate. If you are under 18, you may use the Service only with parental or legal guardian consent.

2. Accounts

To access certain features, you may need to create an account. You agree to:

  • Provide accurate information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity that occurs under your account

3. The Service

ModeMate provides an AI‑powered wardrobe and styling platform that allows users to:

  • Upload and organize clothing items into a digital closet
  • Create outfit recommendations based on preferences or occasions
  • Receive automated daily or weekly styling suggestions
  • Access virtual styling and look‑creation tools

All outfit and styling recommendations are provided for informational purposes only and should not be considered professional advice.

4. User Content

“User Content” includes any photos, images, text, or information you upload to the Service.

You retain ownership of your User Content. By using the Service, you grant ModeMate a limited, non‑exclusive, royalty-free license to host, store, process, analyze, and display your User Content solely for operating and improving the Service.

ModeMate does not sell your User Content.

5. Acceptable Use

You agree not to:

  • Upload content that is unlawful, infringing, or harmful
  • Attempt to disrupt, access, or misuse the Service or systems
  • Copy, reverse engineer, or resell any part of the Service

6. Paid Features (If Applicable)

If ModeMate offers paid subscriptions or premium features:

  • Pricing and billing terms will be disclosed before purchase
  • Subscriptions may renew automatically unless canceled
  • Refunds are subject to applicable platform (App Store / Google Play) policies

7. Intellectual Property

All software, designs, branding, logos, and non‑user content associated with ModeMate are the property of ModeMate Technologies, LLC and may not be used without permission.

8. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted access or the accuracy of any styling recommendations.

9. Limitation of Liability

To the maximum extent permitted by law, ModeMate Technologies, LLC is not liable for indirect, incidental, or consequential damages. Total liability will not exceed the amount you paid to use the Service in the past twelve months (or $100 if none).

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law principles.
